Considering the last 2-3 days have seen a couple of rapid-fire decisions and reversals, I don’t see this lasting until November.

Flynn swore under oath the factual predicate was true when he plead. That’s the complicating factor.

Powell has said it was under duress and with ineffective assistance of counsel and DOJ has now done a 180 and said the prosecution never should have been maintained, but there is a procedural issue in that the Court accepted the plea and now Flynn is subject to the sentencing and jurisdiction of the judge having plead guilty.

I have no idea what Sullivan will end up doing, but this case is a complicated mess that will almost assuredly be ultimately decided by a higher appellate court.

I fail to understand why anyone needs to argue against the government's motion to dismiss. The case was United States of America vs Michael T. Flynn and the government dropped the God damn case. It's not Some Retired frick or Emmett Sullivan vs Muchael T Flynn.

Secondly how can a third party “prosecute” a case when the government withdraws.

Is t prosecution for a crime a government function and not a third party or non- profit function?

he's allowing 3rd parties to file amicus briefs

I don’t disagree with anything you said, but capacity and mens rea are foundational elements of the criminal justice system so how do you ensure both are met during a plea?

The funny thing is you hear from libs all the time about how a plea doesn’t mean anything because of dirty cops and prosecutors, wonder what’s different this time.

Because he is being partisan and attempting to ruin the life of an innocent man

Sullivan cowardly called Flynn a traitor at a hearing and then had to walk it back and apologize

The government set up a 33 year veteran and this POS judge doesn't give a damn. It's disgusting
