A federal judge vacated President Donald Trump’s policy imposing a $100,000 fee for employers’ H-1B visa applications.

The policy violated the federal Administrative Procedure Act and the Constitution, Judge Leo Sorokin declared in the ruling.

The judge found that the payment is a tax that Congress had not delegated to the executive branch.

The Trump administration said it would appeal the ruling.

The judge used the "it's a tax" argument that was the inverse of the USSC "approval" of Obamacare argument, even though revenue was not the purpose of the 100k fee. Absolute scumbag.

Citing Twin City Bank v. Nebeker (1897), the court pointed out the Supreme Court has long held that “revenue bills are those that levy taxes in the strict sense of the word, and are not bills for other purposes which may incidentally create revenue

What makes it a tax? The amount? If so, I would love to see the twisted logic necessary to come up with some random dividing line between fee and tax.

If something else, what? What other fees would meet this standard and be declared as taxes?

Time magazine should have the faceless justice on its cover, proclaiming the image 'Person of the Year'. They could write an entire issue devoted to these woke swamp creatures, highlighting every block they've performed on the Trump Administration.

The fact none have been the victim of violence, is astounding and proof ... we conservatives are incredibly tolerant, devastatingly stupid.

We might be both.

Cool, withdraw the 100 grand fee. Go through the comment period for a 5 million dollar annual ongoing fee
