The charges would be Perjury (18 U.S.C. § 1621) and/or False Statements (18 U.S.C. § 1001). The penalty for either is up to 5 years in prison (up to 8 for terrorism-related False Statements) and fines of up to $250k,

Notice the "up to" qualifiers. IF he is even charged by the DOJ, the penalty is likely to be very minor considering the case would be heard in the DC district court.

What would you have him do? Put on his FBI hat and arrest him? He can't do that. He could potentially refer him to the DoJ for prosecution though. Which I assume will happen.

What came out today showing Smith got the content of the communications? I saw Stefanik and Grassley posting about it too? Something from DOJ, maybe?

I think we knew the part with the red circles and arrows. Interested to see the records showing the contents. That seems like a really easy thing for Smith to get wrong/ easy to prove and show he is lying.
