This is projection and it's inviting someone to do this because it makes the left appear as if that is their desired course of action. Why else would they bring up something like this, if they didn't have it planned themselves?

When you put an animal into a corner, it either cowers or attacks. How long before the American people, especially those that have been targeted by the left, decide to attack?

It's almost like a provocation by the left. These are deranged, evil people.

I think we can all see their game though - they want to push and push, violate the Constitution, target political opponents, and then when the violent pushback comes they want to be able to target half the nation as "insurrectionists" and so forth, so they can go full draconian.

It's manufactured. It's theater. It's a pathological lust for power.

No, these are things that are put into the brief, deliberately, to be inflammatory, dramatic, and fear mongering. They bear all the hallmarks of projection, and are aligned with the words and behavior of the left, to include office holders. That is exactly what they are suggesting, by just throwing it out there. This is exactly how the left characterizes Trump every single day and poof, there it is in a court filing.

The Trump administration and people on the right have been physically attacked by the left, and there have been direct calls from politicians to "get in their face and tell them they are not welcomed" etc, along with Biden's declaration, and the DOJ has not once issued even an opinion or cautionary note on this behavior and how office will not spare someone from prosecution for activities or incitement - yet you want us to believe the DOJ is now concerned about Trump, or that they are legitimately concerned about this list of hypotheticals? No, no one is buying any of this tripe.

These are deranged, maniacal, evil pieces of garbage who found their way into high places within our government. Their mental illness and evil disposition are on full display.

As much as I despise Trump for being lazy, stupid, and not having the sack to do the job but only the lust for winning an election, the man is being targeted and is the subject of political persecution. That is the only characterization for this.

It's worse than pathetically ironic that Smith has the balls to invoke phrases like 'bedrock commitment to the rule of law', as his Department violates law and Constitution with impunity and de facto immunity because they are the ones that should be prosecuting such behavior, and magically, they seem to evade that every time. Violate provisions of FISA, no problem. Profound levels of misconduct with the Ted Stevens case, no problem. Fabricate terrorism cases, no problem. It's never a problem when the DOJ and FBI do it, and it's never a problem when the left does it, but for someone not on the left, then there's a problem. Thomas Mackey has to go to prison for years, for a meme but the 51 intel "professionals" face...nothing.

This is not about justice. This is about power and the sadistic desire to inflict evil upon others. You know this but you can't seem to muster the integrity to call it what it is.

“Lawfare” seems pretty self explanatory, at least to me. I interpret it as the practice of using “law” as a weapon of political warfare. The term “law” is where there might be some varying definitions I suppose.

Weapon is the bigger one.

It denotes some sort of fraud or impropriety. How do we determine that?

This usually goes off the rails here but I'll try again: what if Trump is guilty of the (a?) crimes he's accused of? Can a prosecution be illegitimate or improper if the Defendant is guilty?

Then it becomes a question of how we determine this. I think a lot of people have issues with the jury doing it. THAT creates a lot of subjectivity and lots of subjectivity makes a definition difficult.

Then objectivity in prosecution is paramount in a credible system.
