Could really help set a precedent.

Would be nice if we could get another victory like this so universities can just dismiss it.

They will easily survive, the question is though, will they change behavior and will other colleges follow suit?

BINGO. This is partially the justification of the punitive damages.

Check out Steve Hayward at Powerlineblog.com to see what a piece of work Raimondo is, and the anti-American, antisemitic courses she teaches. Oberlin should be sued by its graduates for educational malpractice

“Anything could be a trigger—a smell, song, scene, phrase, place, person, and so on,” the guide read. “Triggers are not only relevant to sexual misconduct, but also to anything that might cause trauma. Be aware of racism, classism, sexism, heterosexism, cissexism, ableism and other issues of privilege and oppression.” It also instructed professors to “Remove triggering material when it does not contribute directly to the course learning goals.”

Happens in these cases, especially personal injury, all the time.

It doesn't really make a lot of sense to try to draw an analogy here to pure negligence type cases.

I'm assuming you didn't read the article?
I didn't find anything other than the university calling them racist

The majority of personal injury cases are far from pure negligence.

Even if true, Oberlin earned that type of penalty. This wasn't about Oberlin, but they jumped on a family business with both feet before they had any facts.

"Punitive" is a hard term to grasp, I suppose

These people tried to take the food out of the mouths of the Gibsons, their children, their employees and their employees' dependents. They tried to destroy them.

They lied about them, and accused them of one the worst things you can be accused of in America-systemic racism. They, at the urging of one of their Deans, encouraged mobs to intimidate and spread lies about a five generation family business, who had the nerve to take
exception to being robbed.

They tried to blackmail them.

Think about that. A reknowned university tells a small business, that in order for them to regain their cancelled contracts with the university, they should promise to not report 1st time shoplifters from Oberlin to the police, but to the school.
That's what the mafia does.

The Gibsons had to lay off every non-family member working at the store, and did not themselves take salaries for 2 years.

As far as I'm concerned, the jury didn't go far enough.

This verdict is intended as punishment and deterrent - not just providing the victim with compensation.

I would have loved for the judge to stipulate the punitive damages have to go to chik fil a's charity of choice or something.

the jury said that the attorneys’ fees that Gibsons’ would have had to pay out of its verdict awards (often at 30% of jury verdict awards), would now have to be paid by Oberlin College. That could be an additional $10 million put on the school’s plate.

Agreed. Looks like the jury wanted to send a message.

Sucks when you’re getting shot with your own gun.

Punitive is meant to punish. This college thought they could ruin a family with slander and calling them racists.

As long as Jesse Jackson and Obama are revered in the SJW culture; this practice of slander and false racism is not going away real soon.

Is CNN reporting this? hell to the no, if they are it is to take the race baiting colleges' side. I don't think even this amount of money or more-- will get on the MSM news-- as a warning to all of them to fricking stop it already!

A $20+ million gap in general damages & punitive damages just seems excessive. I get punitive damages are supposed to send a message, but it seems high for a family owned bakery to justify getting THAT much.
