Wasn't the shooting an accident? It's been a while, but as far as I can remember the SWAT member who fired was a ways away, and was aiming at his patient who was waving around something silver (a toy car) that he perceived as a gun.
Even still, the exceptions don't disprove the rule, they prove the rule.

"Giving up a rights" carries a different connotation than allowing an officer to, say, search your car. I still retain the right to privacy an hour later, when I'm driving home. The cop cannot follow me and search my home because I gave him a one-time pass to search my car.

Then, if the cop I'm dealing with is a good cop, I will have zero issues.............cause, ya know. GOOD cop.

There are about a million police officers in America, if the majority were as shittily trained as you say, Tyre Nicholes would be an hourly occurrence, not a monthly/yearly one.
