The Insurrection Act is the exception to the Posse Comitatus Act which generally bars the military from civilian law enforcement, allows the president to deploy the military for law enforcement purposes domestically in certain situations, such as when there is a threat of federal law being broken and state authorities are unable or refuse to protect the rights of its inhabitants. President Eisenhower and Kennedy both utilized the Insurrection Act to enforce school desegregation orders.

Trump wasn't going to declare Jan.6th an insurrection.

It was not the commander. It is the mission commander. The commanding general sources. The mission commander determines what sources are needed for task and purpose.

Good question. Maybe it’s a DC thing as it Seems like rules are different there, but I don’t know.

There are several different sets of law at play. The president can federalize the national guard when there is a direct threat to federal safety or in acts of rebellion and insurrection.

He can also ask for local authority to instances not described above.

Because January 6th happened and was over in a couple hours if it went on for multiple days like the Los Angelos nonsense then yeah they probably would have been brought in

Acting Sec of Def Miller.

Testified, under oath, to J6 committee that he had no need to speak with the president on January 6 because, "I had all the authority I needed and I knew what had to happen,"

ETA: that wasn't part of the ABC production of the hearings and strangely escaped Jack Smith too.
