The Boston, Louisiana, Pickwick, and Stratford Clubs, all private men’s clubs in New Orleans, sued the City of N.O. because of the cities harassment, charges of discrimination, and legal actions against the clubs based on Dorothy Mae Taylors discrimination ordinance.
Federal judge ruled against the city. City appealed it all the way to the US Supreme Court, who denied a writ of certiorari in the matter.
So, private single sex clubs are legal.

The problem with a gym is that they may say they are a private club, but they are open to anyone who pays the membership fee. They have no other criteria than that.
So if it went to court they would probably lose.
What if they had some credit check or background requirements? I'd have to imagine these national clubs have a pretty good way of preventing litigation.
