He would still have 5th Amendment protections. What the Ds are trying to say is that, like in many civil litigation settings, if you invoke the 5th at a civil setting then the judge can take a negative inference by your refusal to testify. A criminal court cannot take a negative inference from refusal to testify. However, the Rs are saying this isn't a civil litigation in front of a judge. This is a unique setting that does not follow rules of civil procedure and evidence in the same manner as in a court room. This is a specially conducted hearing with the rules set forth in the Constitution. The Ds are basically using the Constitution when it suits their argument and ignoring it when it doesn't, which has been pretty par for the course for them for years. Literally nothing about this hearing is grounded in Constitutionality. If the SCOTUS does their job, they are going to make that very clear or set a very dangerous precedent moving forward. Unfortunately, I have lost a lot of faith in them over the past several months

Keep in mind the insanity of the Democrat Party. The reason Hillary was fired from her first job was due to discarding research material in the trail of Richard Nixon. She also screamed that Nixon had no rights according to the Constitution ...Yet the Constitution dictated he had all rights. Those are the reasons she was fired. Considering the level of deceit and lies from the Democrats ....no one in their right mind stands before a a kangaroo court. Especially one in which the Chief Justice states he wants nothing to do with the insanity.

The requirement that the President be accused of high crimes or misdemeanors certainly leads credence to the notion that this is more analogous to a criminal proceeding than a civil proceeding.
Hence, I can't see how they would/should be allowed to view a refusal to testify in a negative connotation.
