just bring him back and have the hearing and then deport him
Since they do not want to release him to the US…. And it is an El Salvador citizen….In El Salvador….And he has no citizenship to the US…
How you propose that happen?

What is the exact reason why he was not supposed to be deported to his home country of El Salvador? Personal safety reasons, because a rival gang Barrio 18 would do him harm? I don't know for sure, I'm asking.
If the administrative decision to NOT deport him to his home country of El Salvador was made for personal safety reasons, then, this admin error is arguably cured because he is in the safe custody of CECOT in his home country. He is alive and well in CECOT, as we have seen in recent photos.
It doesn't work that way. They have to have the order rescinded legally, which requires his return for that litigation/due process.
Or they can return him and deport him legally elsewhere. That's fine, too.
Very simple solutions to this frickup. The question is why the admin won't take the easy steps in fixing it.
quote:
At this point, I don't see how there is a legal requirement to cure this Administrative error any further by actually bringing him back to the USA for an additional Administrative Hearing.
Ask the Supreme Court.

His membership in MS13 is not relevant to the legal discussion
Except that his membership organization is a designated terrorist organization

It's up to the admin to figure that out. It shouldn't be complicated for a negotiator like Trump. Bukele is a lightweight with a powerless country in comparison.

Jake,
That doesn’t matter to SFP. It’s an important part of this story though and the media painting this guy as everyday Jose family man is sick.

These dudes are having sleepless nights because we aren't going to do some extraordinary extralegal thing to fix a beneficial error to the United States
Zero comments about supplying Ukraine with weapons that have killed innocent civilians, drone striking families on accident, etc.
It's just so ridiculous. The US makes mistakes all the time here and abroad and isn't meaningfully held accountable, but here's a mistake that unquestionably benefits the country and has a just result anyway, and we've got to do some unprecedented, purely ceremonial stunts to appease the right-minded because Trump happens to be in the WH

SFP has the answer.
“Just bring him back”

Why would they release a criminal, and being in a gang is a crime in El Salvador, to go to a foreign country for an administrative hearing?
Would we do the same? No.

I could be wrong but I think he was calling the opposite side the one engaging in spectacle. I'll await his response

yeah this is why courts of granting TROs
If the admin fricks yo these people are never coming back. and probably never getting out of CECOT.

now ask him if the shadow government lawfare documents against OMB--the Biden Admin had and were released is the very definition of lawfare.
ask him to define: How Judge Cannon was wrong saying Jack Smiths appointment as SC was null and void.

He also said he was in fear that a rival gang would kill him, how do you have a rival gang if you are not in a gang ?

Why? Well they are being paid right? People/ countries do lots of things when they are being paid to do them.

This makes zero sense. It's gotten direct discussion from the VP and President, senators are flying to meet with him, his home country is talking directly about it.
He's "never coming back" because he doesn't belong here, he's home, and it would be a legal and practical absurdity to engage the machinations of foreign policy to get a country to send their citizen to us so that we can send him back (or elsewhere).

Shows the magnitude of this severe frickup
The Streisand Effect in fighting it is now the problem. They could have fixed this immediately and this would be a non-story but they chose violence (in reality stupidity)
