Had Biden just said he was going to look at everyone and select the best possible supreme.

and then selected her. It would've been better optics and gave the illusion that he scoured all potential candidates, regardless of skintone and gender.. and she was the best of the best.
Instead, they started talking about only looking at black females.. making it obvious that her skintone and gender played the most important role in getting the nomination.

I assume that 'they' are trying to avoid what we see in Ukraine, as that is what most educated people are now viewing as the only possible way to a (their) preferred outcome. I hope they are successful, but I know that success is about as likely as the death rate for Covid 19, when one of the Groups has to lie in order to persuade.
Some day. Then again, maybe never, in this particular (Parallel Universe) Level, where free will, choice, and education via consequences is the 'prime directive'. Lord have mercy.

Biden limited the pool of prospective candidates to black women. This is a violation of the 14th amendment which guarantees each person equal protection under the law. It applies to males and women who are not black which demonstrates Biden's deliberate disregard for the Constitution.

Optically? Yes. Publicly stating you are limiting your choice to a certain population makes it look like affirmative action at its worst. I am sure I strongly disagree with Jackson on her stance related to judicial review but I'm sure she is as qualified as anyone else. However, Biden saying he will only nominate a black woman does a diservice to her as it makes it look like affirmative action. If he nominated her and never said being a black woman was his sole reason people would focus on her decisions. However now the argument is the affirmative action argument which is a disservice to her because even though 95% of the PT disagrees with her politics we can't say she is not qualified. With that said I do not want her confirmed and hopefully Manchin will join the right in defeating her nomination.

This is a dumb argument. The President can nominate whomever he wants for any Presidentially nominated position. The 14th amendment limits legislation but not the executive.
