Couldn't find the actual decision, but I can't imagine a scenario where injunctive relief would be warranted.

How could the plaintiffs prove irreparable harm? Unlawful terminations are handled by ordinary means: a suit for damages.

As my former law professor, Justice Scalia (not subtle brag), would say this is total "pish posh."

What exactly is the purpose of the OPM if they can’t direct hiring and firing decisions within the federal government? Seems like they should just cease to exist as well as that’s a core HR duty.

The white guilt some liberal Southerners have is so far gone, it's in outer space. Their complete outlook revolves around making things "right."

This is the same Judge who issued an injunction to stop Trump from ending Obama's DACA program.

Amazing how the Left always gets the slam-dunk party line Judge to preside.

I guess his judge didn't care to render an opinion on firing fed employees who refused the vax

Thanks for adding that... It's amazing how quiet they get when they find out this little factoid...

U.S. District Judge William Alsup described the mass firings as a “sham” strategy

He's going to have to do better than that for any chance of it being upheld.

I would say it is not an HR function to say you must fire all these people and you don’t have discretion in the matter. That is well above HR’s pay grade. HR can handle payroll, benefits, helping with onboarding, and firing people the department decides to fire. They don’t unilaterally decide to fire and order the department to fire people. That has never been a power given to HR.

The Trump administration should send out a memorandum to all the fired bureaucrats saying the following -

To all fired employees:

A biased and politicized piece of f*cking filth judge is requiring us to rehire you. As a result, your position has been transferred to a our newly created Barrow, Alaska office. Please report immediately.

Sincerely,
Your Lord and Savior Donald J. Trump

you do need to insist that most of the blame is on the people in the thread and you are just here trying to educate in your capacity as most celebrated poster

One of my best friends has a son that is a woke rocket scientist (literally) in California. I love him, but hate when I see that same schtick from him that you described perfectly.

Actually, you “muh fight” people posting on this thread just don’t understand. This firing of probationary employees was really poorly planned and executed by the Trump administration.

I do not have an opinion on the ruling. I will kvetch and bitch about some imaginary problem until I have to move my argument to a new position.

And on page 47: "I actually think the judge was wrong on this ruling, but the posters on this board defending Trump are using the wrong logic."

Alsup also said the administration attempted to circumvent federal laws on reducing the workforce by attributing the firings to “performance” when that was not in fact the case. The judge called the move “a gimmick.”

That is correct from everything I’ve seen.

Not sure how this will end. Maybe some back pay liability. But I can’t imagine this will be anything but a small bump in the road, however.
