I can't fathom a scenario where this could possibly be conceived as a good idea unless he actually wants an escalation. In which case it's a much worse idea than OP is dreaming up.

Not if it’s your own flag. Anyone that’s been prosecuted for doing that was because they stole someone’s flag or stole a public flag.

I think it should be either or and if you burn a flag that doesn't belong to you the penalty should be rather harsh.
