My guess is he is paying a premium, but not too much. Once you consider the reverse of valuation discounts for minority ownership (10-20 percent) and what the share price will do between now and close, it’s likely not a bad deal. Plus he isn’t getting the info he has been asking for. Buy the company, get the info, then sue the board and hit the escrow account (if there is one) for material misrepresentation.

Not when you go about it the way Elon did.

Normally you would get an MOU type agreement, lock everyone up with NDAs, call in an IE and/or audit then get reports and bring them back to your respective committees or boards and move forward with a contract.

Musk said frick it, YOLO, right to contract.

Elon has already gotten about 5 billion off the purchase price, by cashing out a bunch of Tesla and using the cash to accumulate 20 billion titter at 42$ the last two months. Quarterly reports in several weeks would have reported the holdings anyway . So I would guess he got half of what he wanted in the lawsuit.
