History has shown us that brutal violence is only ever quelled or turned away by equal or even more excessive brutal violence. Even as recent as the old west, when towns men and women had reached their limits of outlaws and their violence they formed lynch mobs and exacted justice immediately on the perpetrator. The law almost always sided with the mob, the mobs never exacted justice on individuals that were not guilty of their crimes.
When animals do not fear any reciprocations for their actions they are emboldened to continue escalating their violent behavior.
We have become a weak society disguised as refined and enlightened.

Without intent to kill, you don't get 1st degree. You could charge felony murder, but assault doesn't seem to be one of the applicable charges that FM can be applied to in California (which is kind of bizarre).

I'm not doubting the element of premeditation. I'm doubting the element of intent to kill.
However, upon further investigation it does seem as though California accepts implied malice, so you could be right.
