50% chance he goes to jail.

0% it happens before the end of the year.

I'm watching all this breaking news, I'm digging what I'm seeing and hearing but I'm sitting here wondering why it took this long to get to a place where the enemies from within may actually be on the run and the good guys have the hounds of justice on their azzes?

AI Overview

A president's official authority does not encompass actions defined as seditious under US law

Under 18 U.S. Code § 2384, seditious conspiracy involves two or more individuals conspiring to overthrow the government by force, levying war against the government, or preventing the execution of US law through force.

Presidential authority

Article II of the US Constitution outlines the President's powers, which include serving as commander-in-chief, appointing officers, entering into treaties (with Senate consent), and granting pardons.

Presidents take an oath to "preserve, protect and defend the Constitution of the United States".

The concept of "executive privilege" allows the President to withhold information in certain circumstances, though it is not absolute.

The scope of official versus unofficial acts has been debated, especially in recent court cases concerning presidential immunity.

Seditious acts

The historical Alien and Sedition Acts included laws that punished criticism of the government, leading to controversy and eventual repeal or expiration.

The modern federal crime of seditious conspiracy under 18 U.S.C. § 2384 focuses on conspiracies involving the use of force against the government or its laws.

Important: These legal definitions and limitations on presidential power emphasize that a president's authority does not legitimize seditious acts. According to the American Civil Liberties Union, upholding the rule of law protects against the abuse of power and ensures accountability for all, including elected officials.

In essence, the US legal framework and constitutional principles dictate that a president's power is limited and does not extend to authorizing or participating in seditious acts

Remember the hypos during the litigation re: Trump about murder?

I know you're an effective lawyer simply by the way you lie and obfuscate your weak legal arguments. You're good in the worst way.

This will be the final nail in the coffin between Barack and Michael.

Why? Micheal is an even bigger hater than Barack. She was even a jerk to Melania on inauguration day, 2017.

I'm sure she knew what they were doing to Trump even though she wasn't in a position to be part of it.

PS - Hussein recently appeared on her podcast in an attempt to quell rumors of trouble between them, but it was awkward as hell. She has actually been making some strange comments lately, like "I'm not an Obama. I'm just Michelle."

They may officially go their separate ways, but it won't be because Barack tried to sabotage Trump.

So you are saying that while Obama was president he could pursue high crimes such as what happened in a the expressed setup of Trump between other highly placed government individuals and be immune? Oh okay

Question for the lawyers on this board. Even if the DOJ determines that there’s not enough for criminal liability, could they be held civilly liable for knowingly causing others to go bankrupt spending hundreds of thousands of $’s defending themselves from bogus allegations?

Core Official Acts:

The Supreme Court ruled that former presidents have absolute immunity from criminal prosecution for "core" official acts, those within their constitutional authority.

Yes, my point.

These acts were almost assuredly core acts.

I can't imagine this goes up to prosecution of Obama. Plus I would bet that he kept some layer of insulation around himself on this that the underlings take the heat. And if thats the case, the supreme court immunity ruling would come into play. He'll play that he was just acting within presidential authority with information that was presented to him.

A. Obama is also civilly immune. There is a qualified civil immunity for other executive actors.

B. The civil claims have almost assuredly passed the SOL
