You do understand how that relates to the 4th amendment don't you? If you don't avail yourself you are not being denied. If you are not being denied, your constitutional right is not being violated.

Yes, it is. The point was to restrain the government from abuse. The people already have the right and the cops are dedicating themselves to take it away in direct violation of their oath of office. But
