Duty to retreat is misguided.

What if your current position is a good spot for defense? Do you have to move from the cover of an overturned table into an open room full of glass fixtures, glass tables?

Dumb. Hold good defendable ground, always.

frick all of that. Sumter had a right to defend himself, as everyone does or should.

CT is some kind of screwed up if they think running away in every instance is the right thing to do.

If I'm a violent criminal, I'm moving to CT. All you have to do is break into someone's house and start beating them. They are not allowed to fight back. When they run away, take their stuff.

Connecticut asks that you stay away, as they already have enough illiterates.

The statute (reprinted above) does NOT require retreat “in every instance” and does not apply in one’s own home or place of business.

It looks like this guy was convicted because he chased the kids outside and then stabbed one of them.

The theory is that it is better to have someone injured and retreating than to have someone dead.

This is absolutely false. A dead criminal is the best thing in the world.

If Apu chases an unarmed robber out the door of the Quickie Mart with a shotgun and pops a cap in his arse in the parking lot, he's going to jail.

I really wish people would actually read the articles. A couple of years from now, I’m going to see one of you idiots talking about that “guy from Connecticut who got two years for defending himself” while completely ignoring that chasing your attacker in retribution is illegal in every state in the fricking Union.

Beating judges and prosectors for following the law. Hell, let’s disbar and jail them, too.

While I totally disagree with the law, he did run outside and stab him after he got beat down!

If this is true, then he was not defending himself he was getting revenge. I can see the law being enforced here if the guy was no longer in danger, he did not need to put himself back in harm's way.

However, if he was in a conflict and decided to defend himself instead of running away, this is a gross miscarriage of justice.

Connecticut is one of the few States with an affirmative, statutory duty to retreat (in most circumstances).

That duty does not apply in either the home or place of business.

I have no idea what point you are trying to make, given that I made fun of someone who asserted that this duty was applicable in the instant situation.

Repost on OT. And let them do work. I'll find prosecutor's too. And emails.

These criminals deserve inquiries from US citizens who are protected by the US Constitution, regardless of state residence.

A deadly force "duty to retreat" is nothing new. It was even the law in Texas until the mid-90s.

It says a lot about the culture up there.

And how different we are.
