The 9th Circuit Court of Appeals upheld Gov. Gavin Newsom’s ban on in-person church services, in a split ruling that landed Friday night and is likely to further anger pastors who claim that California is trampling on religious freedoms.
The South Bay United Pentecostal Church in San Diego cannot reopen immediately, the two judges in the majority wrote in their order, because in this case “constitutional standards that would normally govern our review of a Free Exercise claim should not be applied.”
“We’re dealing here with a highly contagious and often fatal disease for which there presently is no known cure. In the words of Justice Robert Jackson, if a “(c)ourt does not temper its doctrinaire logic with a little practical wisdom, it will convert the constitutional Bill of Rights into a suicide pact,’” they wrote

Seperation of church and state? Seriously, I know the state represents everyone, not just those in the church, but let's NOT pretend this isn't about repression of religious freedom.

I thought the 9th Circuit was ours now.
WalMart and Publix were packed yesterday.

That's exactly the BS argument the statists used for the Unpatriotic Act.

Exactly. That “argument” can be applied so broadly so as to completely gut the constitution the way the commerce clause has been expanded and abused.

Case needs to go to the Supreme Court.

Even if it were true, the courts still shouldn’t be able to thwart the constitution and the liberty of the people - it’s the CHOICE of the church goers!

Let's hope the Supreme Court sees things differently.

This isn't how it works.

So they found the virus exception to the Bill of Rights in the super fine print on the back?

Wouldn’t it be nice if Barr was in Sacramento this morning....?

Stopped reading here knowing the Constitution wasn’t part of the decision making process.

Who needs Barr when you’ve got the ACLU? Oh, wait...

I'm sure it will. The 9th is the most reversed court, continually misinterpreting the Constitution.

Their version of the constitution is written with a crayon.

They read it wrong. Only thing on the back is a treasure map.

Basically they found fine print that's says "this only applies when we aren't really scared"

No. We’re not.

Old habits die hard but it's another opportunity to for them to get bitch slapped by the Supreme Court

They freed all the criminals to make room for all fhe pastors and church goers. Seems par for the course for a place like California.

Wonder if the police will be in a mood to enforce any of Newsome's decrees after he just recently threatened their jobs if the federal government doesn't bail Cali out.
