I'm pretty sure congress can pass federal laws legalizing abortion and gay marriage.

They can pass laws, and SCOTUS can strike them down and keep that power in the hands of state legislatures where it belongs

Abortion and gay marriage huh. Some Republicans are the worst.

Yeah Republicans

Third trimester: Virginia is the only state that prohibits abortions in the pregnancy's third trimester, which starts at around 25 weeks, per Guttmacher.

No limit: Six states and Washington, D.C., do not impose any term restrictions.

Polymarriage

Should this be defined at the state level as well?

If government was out of marriage and we removed government benefits tied to marriage, it would all be controlled by civil contract. Then companies could decide what they want to offer. Presupposing no threats from government about "equal protection" and "discrimination". There is a reasonable solution to this madness. The left doesn't want a reasonable solution

It's not gay marriage or abortion per se. It's a return to our founders' principles of limited Federal government. The conservative justices are kicking things back to the states where they belong, regardless of how they might personally feel about the issues.

The gay marriage issue revolves around one thing and one thing alone - wether gay couples get to enjoy the same benefits of straight couples. Tax treatment and including spouse on health insurance.

Oh hell yes, this absolutely needs to happen

for damn sure - call it a 'covenant' or a 'contract' - but not a "marriage"

WHY do the progstains always feel the need to destroy stuff that has worked for ages??

I realize they have to confuse everything to the extent you can never pin them down on exactly what they oppose, or what they are advocating for - bu bu bu - hell - I just answered my own question.

Since they don't deal with facts, truth, or logic, the best way to advance is to clutter up and neuter the vocabulary.

Churches can't be forced to marry anyone. It is their choice who they marry. If you are the Elvis impersonator wedding chapel, you are not a church.

All Thomas is musing is that this issue should go back to state issues rather than Federal. Doing that would further clean up the Constitutional law precedents andin reality would change very little in the current landscape of gay marriage.
By our Constitution, if gay marriage is legal in NY then it is recognized as legally valid in LA even if you could not perform a gay marriage in LA.

Redefining marriage was a travesty.
I've never met a gay person I didn't like. That said, this business of hijacking the term "marriage" and steal the essence of a type of relationship and applying it to another is highly insulting to heterosexuals. Not unlike "stolen valor" and the military.

Once again, the left is trying to control the language. Once they do that, you can turn out the lights.

which, if it happened, would return the issue to the individual states, and would conclude "full faith and credit" did not require other states to recognize gay marriages.

The federal government doesn't need to be involved in any issue that touches the individual. Send it ALL back to the states.
If some retards want to marry animals and inanimate objects then they can lobby their state reps or run for a position in their state legislature and make their case.

This is where it should always have been.

100% agree with you , should be a state issue and not a federal issue .

You can keep saying that; it doesn't make it true.

Why isn't it true?

Marriage is a license from the state.

The issue is whether or not the state can give the proper justification for denying that license to a particular class of people.

For now.
There are dozens of avenues for the government to put the screws to the churches to try to change that.

Some ideas include making churches the target of anti-discrimination laws and declaring churches that are open during the week to designated as public spaces which must adhere to rules for public accommodation.

Judge Thomas just wants to clean up the judicial activism that has made a mess of Constitutional law.
