Donald J. Trump is now a private citizen, thus the Senate has no jurisdiction in this matter.

Derschowitz said the same. Which means, of course, that the communists are trying to simply remove the judiciary from the process and say "frick the constitution."

It's unbelievable what these people are doing.

Roberts is saying no specifically so Harris can try and preside over the trial. This isn't magnanimity, it's him absconding his duties to make this an even more partisan railroading.
This makes no legal or constitutional sense.

I remember the day the news broke that Roberts allowed PA to bypass and vote willy nilly for three weeks; and essentially count mail in ballots until Biden won.

The feeling of this board was doom.

I feel the same thing with this thread now. They will get Obama to come in and fry Trump.

They could impeach Trump. Then Trump could sue them and Roberts has already indicated how that would go.

This whole thing is ridiculous and I'm pretty sure they're all on the record saying it's to stop him from running again which isn't going to play well in court.

I'm so tired of the divisive Democrats taking Trump's words out of context (like always) and pushing an agenda (also, like always). If he was pushing for violence, what Maxine said was 100x worse.

At that point, they will literally have insurrection.

You still think "legal" and "constitutional" matter?

The President of the Senate (Kamala Harris) in this case would decide who would preside over the trial. She could appoint herself or one of the longer term senators ( of course it would be a Dem). Probably Leahy.

care to provide some legal context to that statement or is it just made up bs?

Well. He is supposed to. But I don’t know how you’d make him do it.

I saw it floated during the first impeachment that if the Chief Justice refuses to preside over an impeachment or is otherwise unable to (like in the event he is conflicted as a material witness) that he would actually be stepping down as Chief Justice. Thoughts?

Nancy wants to say Impeached twice in his record to ruin him.

More than that Nancy and all the Dems are terrified of a reenergized and potentially vindicated Trump running again in 2024

Nothing Trump said incited violence. The FBI even states that there was a plan to invade the Capital, even before Trump’s speech. There are no facts to support this impeachment, and Trump has freedom of Speech, that is protected.

shhh....the sheeple aren't supposed to know that part.

The Supreme Court did not want to over turn the election knowing it would start riots; even though deep down they know it was stolen!

Constitution says "shall" but, again, if it is not a proper procedure, he would be able to just say no an dismiss.
He is the judge, after all.
