Courts Martial trials are different from civilian ones. There are cases where federal defense attorneys get involved and overturn rulings. Also federal judges can overrule the military ruling.
This is political tribunal, Nothing happens to people who criticized Trump publicly and attacked right leaning news outlets. Anyone who does the opposite of this Battalion commander is politically safe from repercussions.

The high command should be roundly criticized from officer and enlisted alike for the foolish decision of abandoning Bagram and deciding to evac from Kabul. They have the blood of 13 U.S. servicemen and women on their hands for that decision.

Milley is testifying today; and given his record, he should be challenged with why he should not be jailed alongside Col. Scheller.

Lt Col Scheller's entire point was that the rules don't apply evenly. That's why he was speaking out.
If everyone was held to the same standard he wouldn't have had that complaint.
