If it's your position that a ruling on non-citizens will spill over to citizens, that seems illogical: you're referring to two completely different classes of people and SCOTUS has certainly divided those classes in many different cases through the years like in Hamdi v Rumsfeld. I can understand fear of the slippery slope and judicial activism though. I can get that part. But, the principle of equivalence is not something I would agree with.
