Right. Mueller's scope is Russia.

This new SC can focus on the 14 points outlined by the HJC and Sessions can continue with "normal" work.

I THINK this Justice Departnment could investigate this mater succesfully, BUT certainly the facts outlined in that letter could justify a special counsel.

The Attorney General, or in cases in which the Attorney General is recused, the Acting Attorney General, will appoint a Special Counsel when he or she determines that criminal investigation of a person or matter is warranted and -

(a) That investigation or prosecution of that person or matter by a United States Attorney's Office or litigating Division of the Department of Justice would present a conflict of interest for the Department or other extraordinary circumstances; and

(b) That under the circumstances, it would be in the public interest to appoint an outside Special Counsel to assume responsibility for the matter.

Correct. It's warranted. Objectively, there is really no other choice. Unless on its face there is nothing there.

You can probably make a pretty damn good case for conflict of interest given the fact that many current DOJ employees would be investigating their former boss without a SC.

As I said, it's clear that a special counsel COULD be appointed.

However, I still believe that Mueller will be relooking into all that anyway.

And I don't think it would be a bad decision; I just don't think it's the first decision to make.

I think they would need to establish whether it's worth investigating, and if so then consider whether they think a special counsel is optimal and/or necessary.

I was ready to let the e-mail stuff go, but some of Comey's comments really bother me.

A lot of people have had their lives wrecked for carelessness with classified information. That aspect still doesn't sit well with me.
