It was also meant to deter insurance companies from clogging up dockets with $15,000 cases. You wouldn’t get a trial date for six years if they didn’t have to put up the $5k cash to secure it.

The bond is not an issue for the 3 insurers I represent. They look at it on a case by case basis.

Sure, but if there was no requirement of the cash bond, do you not think the majority of the insurers would automatically move for a jury on anything between $10k and $50k?

Given the dearth of civil jury dates, especially outside you major metro centers, you’d be looking at a backlog of years. Or you’d be set as a 35th fixing on the last remaining date on the court’s calendar.

Many of the old style bonds are above $5K. I ask for a jury every time(ten day rule) and then we decide within 60 days of that. So many small cases just don't need this. Too much to go into here.

But as to the premise of the OP, I think the biggest problem is the over play of future meds. It's bullshite. The State needs some kind of escrow program.

Of course!
Lawyers are a dominant reason for exorbitant insurance rates in ALL ventures where insurance is required/common practice.

Not a reply to you but true

As for Florida, I would say the Plaintiff lawyers are substantially responsible for exhorbitant rates.

Anyone visiting here knows why! I can describe the entire scheme for you later if you wish. Suffice to say, the legislature made massive tort reform effective March of this year.

If you want to know how messed up the system was before, plaintiff attorneys filed over 30,000 lawsuits in March before the new laws took effect.

What eventually will lead to lower premiums will not have any effect for at least 3 years because of this.

The stupids in Louisiana who are on their 5th DUI, suspended licenses, and who should be underneath the jail, are a direct correlation to the Ambulance Chasers. They defend drunks, make sweetheart deals with Prosecutors and Judge's to keep their clients out of state prison, then turn around and sue that very same drunk when they kill someone driving under the influence.

Agree, but it’s also the police and insurers. If the police would have a non-insured car towed immediately and leave ‘em stranded on the roadside and loss of license for 6 months, and insurers didn’t punish us for the scum, rates wouldn’t be so high. They’d find insurance. Also? No insurance? You can’t file suit.

Assuming your post was about Louisiana and you did not read mine directly above about Florida

I'm not commenting on your state but Florida is directly affected by plaintiff lawyers

If lawyers are the issue, why didn't tort reform lower your insurance rates as promised?
Because the new rules really didn't change much.

Even the insurance industry knows lawyers aren't the issue, and they always knew this. Even when lobbying for tort reform they knew this.
Well, this is false.

It also changed the Collateral Source Rule. That rule changed limits the recovery of your past medical expenses. If you have health insurance that you paid good money for, the insurance company for the person that hurt you gets the benefit of the health insurance and the resulting discount even though you paid for it.
You're not telling the whole story, and this is exactly how it should be.

The lobbyists hatched a scheme to claim that personal injury litigation was a driving force behind rising car insurance rates.
I mean, it is.

if insurance companies did what they were supposed to do, there would be no plaintiff lawyers.

Oh please.

A lot of misinformed people thought tort reform was good.
It was good, but did not go far enough.

Everyone hates lawyers. Until they need one.

And the reason they need one is why? Ever since 1977 when the Supreme Court agreed that lawyers can advertise, the flood gates were open telling you to hire a lawyer and get rich!
