Depends on what he said.
Objectively, 86 anything can mean a number of different things. But not sure what he said exactly.
If you in very plain and clear language say I'm going to kill you, sure, that can be prosecuted. But 86 .. not so much.
Any cop or lawyer could tell you this.

Former director of the FBI that has info and friends on the inside can do some damage. Ultimately nothing will come of it ,but this is a threat and he should be probed.

We had a lengthy discussion about this in a thread I started about it a couple weeks ago.
“8647” is absolutely not free speech when it’s being done to incite violence or lawlessness, or if it’s deemed a legitimate threat. There are entire Supreme Court cases that have been litigated about this.
Comey should be locked up.

You have to be pretty specific with threats, especially when you use slang or colloquialism. It isn't like he said "we need to pop a cap in his arse" which leaves almost no room for interpretation. 86 is used to mean "kill" but it is usually "get rid of" which is vague enough to let this slimeball slide.
What's coming his way is assloads of free press, increased book sales and more money.
He knew exactly what he was doing and he's grateful for MAGA's indigant contribution.
