Not arguing - and not agreeing. Just have a question that maybe someone can answer with certainty.

I have always been told that a game warden can come into your home or business without a warrant and can conduct a search. Is this true or just an internet fable ?

They can't come into your home without a warrant.

They don't need a warrant to search you, your boat or car if you are in the process of or just finished hunting/fishing.

That may vary by state. I know some states sheriffs will call in DNR to break cases and conduct searches where the sheriff doesn't have enough for a warrant, but the person has a valid hunting/fishing license then DNR can waltz right in with flaky made-up BS for a cause.


Example-

Guy has a grow house out in the N GA hills on his property. Cops know it, but can't get enough cause to get search warrant. Bring in the DNR to walk the land without a warrant supposedly looking for poachers. DNR finds grow house. Instead of making the bust, DNR signs affi "we found weed while searching for poachers" to get the sheriff the warrant. Sheriff comes in and makes the bust.

Then why are you worried about the replacement cost for the fish if they aren’t selling it? They didn’t buy the fish. They caught it. They weren’t guaranteed to catch anything.

I don't care if the they get their money back from the captain. That's $1600 worth of goods that is gone.


Again, they never owned the fish and so they didn’t lose out on the cost of Tuna. They will be okay with a refund. They can plan another trip some other time and hopefully catch plenty of fish. Look, I agree that it sucks for them. At the same time, the game wardens didn’t charge them with anything or “essentially fine” them either. If it’s their policy to seize fish taken by illegal means then they did what they were supposed to do. Think about all the people who will get to benefit from the donation of it and can’t afford $20/lb.

As far as they were concerned they owned the fish when they caught it and heading back to the dock.

Never said it was and I don't feel that it is.

Just sucks that the clients are getting screwed because the captain (or should I say the boat driver) decided he didn't need the necessary licenses and documents.

Only legally speaking. They obviously caught the fish. Unfortunately the law doesn’t consider that fish to be owned by them.

Depending on lines on the map, fish is property of the state of La. one must possess certain state and federal licenses & permits to harvest said tuna. Captain will pay restitution to the state.

Illegal AF.
