I think criminalizing negligent behavior is poor policy and should be abolished. JMO, and obviously lots disagree.

Guess that's my stance as well, you just said it better!

I'm not saying throw him behind bars for life or anything but a fine, loss of hunting privileges for a few years would be nice.

So it should be a civil matter and not a criminal one? Why does that not surprise me.

That sounds reasonable.

If it were someone in my family behind bars would be the safest place for him.

Zero tolerance for this....zero

There was a guy here several years ago who mistook a squirrel hunter for a deer and killed him. No charges, tragic accident, etc. he went on to kill 5 deer that year. Didn't mess him up too bad

Filled his tags... nice.

How does one shoot and kill another hunter thinking he is a deer. I truly have no concept of how this happens
It should be impossible. I think when it happens the shooter should see his day in court for both possible murder or gross negligence

So if I accidentally shoot a black bear cub thinking its a hog, which is pretty reasonable, I get the book thrown at me, but if I shoot a deer thinking its a person I get off free???
THIS THIS THIS!!! When did bears become more important then humans?

They are not. That's a game law and a ridiculous argument.

Possible murder? I've watched enough law and order to know you're a dumbass for saying that

I think the shooting has been investigated, I don't think putting the kid in prison serves any purpose. I would support punishments such as a lifetime ban on firearm possession.

The brain will fill in the missing details. These people truly believe they saw an animal.

No. These people truly saw something moving in the brush and shot at it before clearly identifying it. Technically it's an accident, but that doesnt mean it should go unpunished. Assholes like this scare me more than running into a bear. There are far too many idiots in this world than there are responsible people.

No.
Many do. There is no debating that.

What is your philosophical reason for punishing an accident?

The actions he chose had far too many risks that effect others beyond himself. That is why he should have some type of punishment because his behavior is entirely too risky.

Taking a shot at an unidentified object is like drinking and driving to me.

Do you read this board? People on here talk all the time about seeing animals that do not exist. People see bear on the side of the interstate. They brush shoot. They get spooked and fire off rounds behind them and into the woods because they KNEW something was stalking them.

Is there punishment for causing a car wreck and someone getting killed?

Would this be the same thing. Negligence on part of the shooter.

I know this normally goes unpunished.

I cannot speak for every DA/Parish, but from what I have seen, if no impairment, no charges result.
