Like I said. Just my opinion. The boy is a well known predator hunter (at night). And has taken some big deer. Certainly not a crime but you better be on your p and q’s because that is gonna draw a little attention in itself.
Having said that. You glass a deer at night (which he admitted to) and have a loaded rifle with thermal within reach, and have a lookout/driver (which is how most all night road hunters operate)…
Yeah he was 100%night hunting, absolutely no doubt in my mind. You don’t stop and look at deer in that situation. He knows that. Green jeans knows that. Which is also why he continues playing dumb saying “so it’s a crime if you don’t shine a light on em?” So he knows you shouldn’t shine deer but doesn’t understand that using thermal is an invisible spotlight? Lol yeah sure bud. He would have lit that deer up had he seen heat.
Road night hunters are absolute scum of the earth.

I live in the country and usually have a rifle in a case in my back seat. I would (and do) think nothing of pulling over to look at deer standing in a field, day or night.

Ok cool. I do too.. unless I have my rifle in my truck, then I consider the possible trouble it could make for myself. Kinda like taking a pistol with you to a protest against law enforcement, it’s just dumb.
I’ve been checked twice this year by green jeans. Both times at night. I was parked on the side of gravel road checking trail cam pics on my phone both times. He asked to see my rifle. Once he saw it was in a case and unloaded he said have a good night.
Sure I could have had it loaded and within reach. But I would rather make my life easier and remove all doubt. Not do something just because I can.
As much as this particular guy night hunts, he knows the law. He used a technicality to weasel his way out of a life changing charge.

I have avoided legal trouble my whole life by using that one simple trick, the "technicality" of not violating the law.

here's a metaphor. game warden puts a near naked stripper on the corner as a sting and a young man stops and asks for directions to the super market and then gets arrested for solicitation.

I do not care to interact with any law enforcement at any level because I do not care for the state to be interfering with me living my life but you gotta admit, as bad as this video is, game wardens are simply not as scared of the public as policeman. This warden KNOWS this guy has a loaded weapon on him...and barely reacts when the guy acknowledges it. Had it been a cop odds are good this old boy would have had a bad night made much worse because cops are scared to death of a gun in someone's possession other than their own. Game wardens could not operate in their world if they suffered from the same irrational fears that most cops are crippled by. I have been checked by game wardens hundreds of times with a loaded weapon on me and its almost completely overlooked. They may check for a plug, they may only ask about a plug and if everything else seems fine that's about the extent of their interest in the loaded weapon. That's just hunting. I don't know that I have ever had a warden mention my having a loaded gun when being checked while fishing or boating. Most cops would have a case of the vapors if they encountered as many loaded weapons in a career as a game warden does on dove fields in one season. I don't much care for game wardens either, they are still agents of the government intruding in my life, but at least the idea of a loaded gun does not scare them to death.

It won't harm their career. They will probably be "reprimanded" but finding anyone qualified who will do the job for the money they make is damn near impossible.
I know the initial warden both as a warden and socially. Not friends or anything but I have had interactions with him professionally and socially through mutual friends and he has always seemed like a decent sort. Not surprising, the job requires them to act the way he did in this case....while it is pretty bad it is also pretty dam tame. I know cops also who are decent sorts but their job means they are complete assholes most of the day. Its the nature of the job unfortunately. It doesn't have to be but it is.

The measure of success should be preventing crime, not making arrests, but when arrests are necessary the measure of success should be conviction rates. Obviously these 2 are taught that seizing trucks is a good thing for the agency. It actually means they failed to prevent a crime....can't seize a truck until a crime has been committed thank goodness. The fact that shining a spot-light at a fricking deer in a field is a crime is bad enough, add to it that the punishment could be the seizure of a $70K vehicle and its outrageous. This guy did not shine a light but only stopped....I do it all the time. I like viewing wildlife. That ought not be illegal. If they thought the guy was about to shoot the deer they were right there.....hit the blue lights and the siren and stop the crime before it happens. So what if old boy drives off? The point should be the prevention of a crime....job done.

This is the main reason I left Washington State and moved back to Georgia. I was almost arrested for fishing during fishing season with a valid license in March of 2020. I was by myself and until the game warden approached there wasn't another living being within a mile of me. They closed ALL fishing despite having sold me a license to fish with an implied contract that the price of that license granted me the right to fish within the prescribed limits imposed by the Washington Department of Fish and Game. They did not close fishing....the Governor did. I did not have an implied contract with the Governor, my contract, which was valid, was with the DFW. The warden admitted this while detaining me. They had been directed to enforce the executive order of the Governor. I would have been arrested if it had not been for the local Sheriff who, when the warden escorted me back to his parking lot, was engaged with about 9 other wardens and about 100 fisherman at a boat ramp. The Sherrif told the wardens no one was going to be arrested. They had about 30 deputies on the site at the time and they simply were not going to take 100+ people into custody for fishing no matter what the governor said on the matter. This happened across the state of Washington on the same day. The governor rescinded the order about 6 hours after this happened. The fact that the state would close ALL fishing for any reason and knowing how that would go over in Georgia was enough to convince me living in the PNW wasn't going to work out for me.....

It looks like it might be open to anyone year round as long as it’s private land and its registered.
It says people with DNR permits can hunt unregistered land.

You’re absolutely right, but I would argue that the system also creates more dicks via the incentives. They get rewarded, promoted, pay raises, etc for being dicks. Few people have the backbone and moral integrity to avoid becoming a dick when money and prestige are the reward.
The system is flawed and needs to be reformed at every level of law enforcement. Civil asset forfeiture (like taking a truck from a citizen accused of a crime) should be illegal.
