Open fields doctrine is being challenged in Louisiana

With onXhunts there is absolutely no excuse why anybody, gooberment or otherwise, cannot contact the landowner. Trespassing is trespassing.
Game Wardens have a tough job, they don’t need to make it tougher on themselves….. just saying.

Looks like Tom made the list in 2019. Once you’re on the list, they will harass the f out of you at least for a few years.

I still don't understand how constitutional law doesn't override this "doctrine" or authority given to game wardens. As stated in this thread, trespassing is trespassing, and the 4th amendment is the 4th amendment. The fact that more green jeans don't find themselves at gunpoint while doing this is striking.

It's because they interpret the ruling incorrectly intentionally. It's the basis of all their authority. Open fields was intended to give them authority to investigate when they can observe hunting taking place in an "open field" where privacy is not reasonably expected. They interpret it as long as they suspect hunting is going on the can enter a property because you shouldn't expect privacy on a piece land.

I think Alabama challenged and won. Really hope Tom wins. It's government overreach and intimidation.

As few game wardens as we have in Louisiana, they should be using them to harass land owners. They should have their hands full taking care of other issues. Land owners have a tendency to take care of their property and to hunt in a manner which will grow wildlife populations.

But, I know they like to act like power hungry morons from time to time.

Respectfully, that’s an awful broad brush to paint with. If we’re talking tendencies, game wardens have a tendency not to focus their efforts on private landowners. Sometimes they need to.

Maybe that's what it will take...These guys can just as easily sit by the gate and wait for someone to leave if they want to check them. Or they can even wait at your house for you to drive up.

This happened to me because there was a protein feeder in the opposite corner of a 300 acre field..

Hunting over bait is subjective as shite..
