Getting deposit back from outfitter

I scheduled a deer/duck combo hunt for 4 of us in Arkansas. I paid a $3100 deposit back in February 2024. The outfitter called me to reschedule our original dates that would not work out for us. He said we could reschedule for next year, but I told him to just send back the deposit and he said he would. He is now ghosting me. What would you do in this situation?

Hire a local attorney and get your money back.

I paid a $3100
Hire a local attorney
That'll cost you another $5,000 to get $3,100 back (maybe).

Is this a reputable guide service?
I would Google the guide and see if there are any other bad reviews similar to yours

Maybe a mix of what others have said in this thread.
Threaten to sue, but be fully prepared to follow through with it if it continues.
F these guys

Sue them for court cost and attorneys fees.

What outfitter? No point in protecting them if they are fricking you out of $3k. See if anyone here has come across the same problem with them…if not then at least your OB brethern can help harass them into sending your deposit back

If you don't get your money back, split the loss amount by four. Your buddies need to pay you back their proportionate share.

I don’t know about that.

Did you cancel because dates did not work for you? Or the outfitter asked you to reschedule?
If you cancelled because you had a problem with those dates; then that’s your fault. Deposit holds the date for you that he could have sold to someone else. Push the date to next year (guide doing you a favor) or forfeit the deposit.

Did the outfit have to reschedule or did your group have to reschedule?
If your group had to reschedule you’re SOL, that is the exact reason outfits take deposits, been in the business for close to 50 years, if you have to reschedule, you’re more than welcome to reschedule your dates, but you’re not getting your deposit back.
Now if the outfit had to reschedule that’s a totally different story.

If reschedule is due to something on your end, you shouldn’t be getting deposit back. That is the point of a deposit and you shouldn’t expect to get it back if you just outright cancel.
If guides have time to book another trip on date you had scheduled, sometimes I have seen them refund it. But from their view, they blocked out a date for you and cannot book for others so if you cancel they don’t/can’t make money that day. The deposit guarantees they don’t lose a day they would otherwise make money because you decide not to go. It sounds like he offered to hold deposit and reschedule (which is typical) but new dates won’t work for you which isn’t really his problem.
Not trying to sound like a dick but that’s typically how that business works, and I don’t think he is in the wrong on this.
However if he is the one driving the reschedule and you still want original date, it’s a different story and he should refund deposit.

Yeah, this is pretty ambiguous.

It sounds like the original dates no longer worked for him (the hunter). In which case, the deposit should be forfeited, IMO. I thought that was the whole point of a deposit?

How long has he been ghosting you? From the looks of things, he’s probably pretty tied up right now

I read it as the opposite. Guide called him to say he would need to reschedule, but OP can’t do the dates he’s wanting to reschedule for. I 100% would demand my deposit back in that scenario, and wouldn’t expect it back in the opposite.

Until the OP clarifies for us, it’s hard to say.
The only thing worse than getting ghosted by an outfitter, is getting ghosted by the OP.
