A salmon fisherman who abandoned ship by leaping into the frigid waters of the Columbia River last summer -- an instant before another motorboat crashed into his -- filed a $372,500 lawsuit last week against the other driver.

quote:

Clatsop County sheriffs deputies accused boat driver Marlin Lee Larsen of several crimes after the 75-year-old told investigators he couldnt see where he was driving because he was sitting down and the dash of his boat was blocking his view. Larsen said he probably should have been standing, according to the sheriffs report, which notes Larsen uses a motorized scooter to get around on land.

Wow....video is halfway down. I heard about this last summer. Had been in that area 2 days prior. You see a lot of boats, upwards of 500, in that area. It's only open for 1 month typically.

We always see reports of boaters/fisherman being found dead with no pfd. I've had my own close call, so I always wear an auto inflatable pfd.

Please wear your pfd folks.

The driver is quoted saying that the suit is unnecessary because they weren't horribly injured

He also pleaded not guilty to reckless driving

The SOB that hit them should be tried for attempted manslaughter X3

I don’t GAF how old he is. Almost erased three human beings from this Earth with his negligence

Larsens son-in-law, who also was on the boat, told investigators that he had warned his father-in-law to pay attention, that he sometimes sees his father-in-law using his cell phone while driving the boat and that his father-in-law had been off-and-on his cell phone the morning of the crash, according to the sheriffs report.

Snitches get stitches, or left out of the will.

Why? Was it intentional? He shouldn't be allowed to operate a boat anymore alone, but prison for that would be stupid.

Based on the limited facts published, I lean this way.

Reckless (wreckful ??) driving is a better analogy.

He (or his insurance company) needs to pay for the destroyed boat and whatever medical/pain & suffering/damages he caused. And he needs to be barred from operating a motor vessel.

But prison is over-the-top.

Saw pics of that boat last year at the dock after the accident. Couldn't see a scratch on it, but it was in the water.

We don't see many of these around. 95% aluminum boats.

Why does that matter when....

Although Oregon law heavily restricts cell phone use while driving, there are no such specific laws governing boating. But it is against the law to operate a boat without due care .
