Yea...

I don't think anybody's head should roll for this. The guy driving the boat should get A BUI or DWI or whatever they call driving a boat wasted, but beyond that I'm not sure what should be done. If a person jumps off my boat while I'm running and I run over them and kill them, do I go to jail?

I feel bad for what happened to this girl, but don't really care because she doesn't look hot. Stupid people make stupid mistakes that result in shitty results for themselves.

As you stated, everyone can fall out of a boat. But, not everyone gets run over. The person controlling the boat was definitely at fault.

From what I got from the OP they weren't moving, they were just drifting and she was standing on the bow, which is totally legal, and people do it all the time, it wasn't until he slammed it in reverse that she fell out, then he ran over her.

I'm not saying her drinking didn't contribute to it, but this exact same scenario could happen to totally sober people and an inattentive operator.

I'm definitely not saying this absolves the driver, but she was legally not supposed to be on the deck while the boat was underway, just like the driver was legally not supposed to be driving drunk. She's also at fault here IMO.

ETA: Nvm. Just re-read it. Looks like if somebody gets up there while you're driving, it's your fault.

Only if you are drunk. If you are drunk and a car runs a red light and you hit them you will get charged, even if you aren't at fault. It's the risk you take drinking and operating a vehicle/boat.

With that said, I agree everyone that was on the boat was partly responsible. I'm pissed at her for being stupid. I have a lot of friends that had never been on a boat until they were adults (she's not one of them, she grew up hunting and fishing and she knows better), I've preached to them many times the dangers of being on a boat and being drunk, but very few listen. Hopefully she'll come out of this ok and they will all learn from this accident.

They were breaking a lot of laws. Operating a boat under the influence, public intoxication, weren't wearing life jackets on a running boat, on the bow of a running boat, and more.

The person controlling a boat or any motor vehicle is responsible. The driver is definitely at fault here.

I would put the boat driver at 90% his fault. When you operate a boat you need to be aware of who is on your boat, that they are safely seated , and dveryone is ac ounted for, before going away.
