When I uploaded videos that have copyrighted songs in it, there was a message that said the video couldn’t be monetize but it still uploaded and was not taken down.

The composition is out of copyright, but a recording may not be. Just because the underlying work is public domain doesn't mean someone doesn't own a particular recording of it.


In this case, YT's assumption that the recording belonged to Time Warner would have been wrong. This seems to be one of the bigger mistakes the bots make and is a massive hassle. In this case, the person who recorded themselves playing it would have owned the recording. The algorithms aren't savvy enough to differentiate between some recordings causing this kind of issue. They really need to have a better/faster way to determine these things.

It's an automated algorithm. They only have people check that shite when the copyright strike is challenged.

I have it happen on my Instagram all the time b/c I usually have music on in the background when I video my dog acting like a derp. I just challenge it as fair use and since it's obvious my insta isn't a money maker 99% of the time I win.
