A reasonable person would know that there is a good chance someone could end up dead during the commission of a felony. It's actually pretty easy to avoid the felony murder rule for those who don't go around committing felonies
That doesn’t make one a murderer.
A 15 year old will forever be known as a murderer, despite not ever even attempting to murder anyone.
That’s dumb and cheapens the concept of murder.

What about hiring someone else to commit a murder? Does charging that person with murder also cheapen the concept of murder? They weren't the ones who did the actual killing

No. Not dumb at all. Also not a new concept. If someone dies while you are in commission of a felony, then you are charged with felony murder, even if you didn’t pull the trigger. You set the events in motion in which someone died. Thus, you pay the price.
It doesn’t make sense because no one was actually murdered.
Shouldn’t there be a victim in a murder? Who is the victim here?
Furthermore, there was only one killing and it was in self-defense. How can a self-defense killing be called a murder?
This is clearly a case of the ends justifying the means. It doesn’t make sense, and people know that but don’t care because it punishes people they don’t like.

A perpetrator was killed. The law does not allow the prosecution of the person acting in self defense. His accomplice does not get the benefit of his victim’s “self defense” argument.
When you commit a felony you are responsible for all of the consequences that flow from that felony, even death. I have no problem with this law.

Armed robbery is threatening severe physical harm for not complying. frick this kid wish he had gotten what his friend got.

This concept is not uncommon in many situations. This 15 year old pulled out a gun with intent to threaten and assualt another. He set into motion the series of events that caused the death of his "companion". At first listen, it may sound a bit of a stretch to hold him responsible for the murder of his "companion", but there are actually quite a few criminal actions resulting in a death, that otherwise would or could not have happened, that are interpreted as "murder". Some are "second degree" murder but murder nonetheless... E.G: Anyone who gives another person drugs that result in the death of that person is considered guilty of second degree murder.

i don't appreciate anyone who uses a gun to commit a robbery.. they were carrying right?
a woman has to live with that for the rest of her life.. and all the horror that surrounds it..
tough shite if he's known as a murderer.. most people who know him will know the actual incident any ways.

Yup.. That is absolutely horrible.
It's one thing if they were pick pocketing, or trying to sneak items away.. it's another to straight up point a gun at someone.
Screw that.
Posted on 6/28/19 at 1:26 pm to sumbodyorsum1
Completely agree. Pick pocketing isn’t a felony. So, no felony murder.
When you point a gun at an innocent lady minding her own damn business...you damn well better pay for the consequences of anyone’s death in that scenario.

We need more "feel-good" stories like these

but Ohio law allows people involved in crimes to be charged with murder if the crimes result in any deaths, the Cincinnati Enquirer reports.
We have this in FL too.
There was a interesting case in AZ (they have it as well) where some punk tried to rob a gas station with a realistic looking airsoft pistol and the older clerk had a heart attack and died. Dude was charged with murder.
I know here in FL you have to serve 80% of your sentence before being eligible for parole if someone dies while you're committing a felony.

And this is how it is supposed to work.
I wonder if a dead friend and doing some jail time is worth whatever they were trying to rob the woman for?

This is great. Two pieces of shite are off the street with one blow.

The dead kid made a fatal error in the victim selection process. The live kid made an error in his choice of friends.
