Sounds like a 3rd party complained about her driving and when he tried to detain and question her in reference to the complaint she refused his orders and tried to leave, prompting an evading arrest charge.

The 3rd party is probably who was in the black truck and called her a black bitch.

If there was no accident, why does she need to be detained and questioned by the off duty chief?

Again, if there was no accident and if the police chief wasn't involved, and didn't see what happened, why should he take the other guys word that she was driving erratically?

Why should he even involve himself in what sounds like a non-issue?

This lady sounds very believable to me.

It is to the point all officers will need body cameras with recording devices. They need to make the cameras and recorder smaller.
Then their is no dispute to what has happened.

First off, we don't know what the complaint was.

If the police was given the complaint of a reckless driver or impaired driver endangering the public....shouldn't the police investigate that complaint? Should the police wait for the accident to happen instead of possibly taking steps to stop it?

Are you suggesting the police wait for the driver to run over a child in the parking lot before they step in?

Maybe the complaint was that she threatened the complainant which constitutes assault....shouldn't the police investigate that complaint and follow up on that?

If you report to the police that you have been threatened and they tell you they didn't hear anything and aren't responding...are you going to be ok with that?

Yea, I'm gonna call BS & lean towards the woman's story unless more evidence comes out. Any cop that uses that insane tactic to secure an arrest is an irrational power abusing a-hole

There are cops out there who are truly professionals and upstanding people. The sad thing is that they're in the minority.

Police legally can detain and question you if they have reasonable suspicion to believe a crime has been or is about to be committed by you....even if it is later determined that a crime was not committed.

They still have the power to detain and investigate it.

By resisting this detainment that legally constitutes Resisting Arrest.

Like evidence that the chief doesn't have a 14 year old daughter or that the woman is now unsure if the police chief was indeed the person that she encountered prior to going inside Walmart?

Is it possible that maybe...just maybe...the woman mis-identified the chief and over-reacted when approached?

Whenever drunk drivers pull out in front of me and drive dangerously, I always pass them to get out of the danger zone.

If I see a car driving erratically and think they're drunk, I'm falling back behind them so I can see what they're doing and have time to avoid it.

Except for the part where the chief doesn't have a 14 year old daughter, her attorney said there's no bodycam footage but there is, and that when she got out of jail she looked up the chief and recognized him as the man that verbally accosted her but now she's not sure. Other than that, yeah, very believable.

Seriously, neither party is claiming that any of the shite you made up happened. None of it occurred beyond your mind. Are you subject to urinalysis?
