The one he took out of his open glove box, where he always kept it. The one they holstered and planted between seat and console.
His wife testified the gun was kept in the glovebox.
The glovebox was open in Smiths car, and the gun was no longer in there
So, the most logical thing is he removed the gun. But that is not hard evidence. Technically, he could have decided to ride around with an open glovebox and gun between the seats that day
There was however no evidence other than Hayes himself who saw smith with the gun.
The only thing Fuller could offer was police corruption, which nobody was buying.
My personal opinion, is smith got the gun, his wife talked him out of using it, he never was going to use it, Hayes freaked out based on the commotion in the car, and shot and killed smith
He deserves to go to jail

gun would have been clearly visible in that video had WIll been able to grab that gun. Gun was unfired and still fully loaded.
