Yes i do find it weird that that is on record. I also find it weird that no one under oath has mentioned seeing Hayes come out the car with a gun. Nothing that happened after the 2nd crash meshes with Hayes coming out of the car with a gun.
-Hernandez trying to fight someone doesn't happen if Hayes has a gun
-Will Smith & Hayes hand jockeying doesnt happen if he has a gun
-Raquel Smith getting in between the 2 doesnt happen if Hayes has a gun
maybe he got out with the gun in his back waistband. It could have not been in his hand. The 2 men in the car would have then both known that he "got out of the car with a gun"

I agree with Lester. No one other than the ADA has said that Hayes got out with a gun
When did Hayes say that? He hasn't testified and not sure if I heard that he will take the stand.
Was it part of the 911 call tape?

There is no other way for Hayes to have gotten out of his truck with the gun other than being in his hand where he put the gun from that point maybe of question

you clearly were confused. from the very start I said you neutralize the threat and that perhaps smith was in the process of falling or still moving after falling that is why there may be a pause, which if there was a pause you are looking at 1-2 seconds, not 30 or anything crazy. but hey, it seems you are more interested in making an arse out of yourself so carry on.

diat responded that it is a common technique, speaking of shooting multiple times.
You tried to have an aha moment, and assumed he was talking about hte pause. diat never once referenced the pause, nor said pausing is the technique. He was very clear neutralizing the threat and shooting multiple times was the technique he was referring to

So, it was O'Neil who was shaken and exasperated. (paraphrasing here} Not Hayes, as described by officer arriving on scene. Where was Hayes and what was his frame of mind? We know gun was possibly on hood.

I answered your question, and I quoted the reasons I think he left with a gun.
Specifically, that he's now quoted as stating he left the vehicle with his gun while his friend gave an interview where he is very, very, very specifically said to have had his gun when he left the vehicle.
