Not to my knowledge, but I imagine their will be evidence to suggest or prove it because the prosecution brought it up in their opening.

I doubt they even tested Smith for GSR. Fuller may be bringing this up to raise reasonable doubt...

At FQ Fest, Smith saw a sign prohibiting guns. "I don't know where he put the gun," R. Smith says. Only that he opened driver's side door.

That may be the most damming part of the prosecutions opening statement. It would mean that Smith wasn't reaching into his car if that was the first shot. Smith would have had to have his back to the car.

Much harder to make the case that Smith was engaging in an overt act of retrieving a weapon that he intended to use to shoot hayes.

Not suggesting anything.

It is possible that the gun was put there after the shooting though.

I keep going back to the vehicle not being searched at the scene and the evidence not being collected until Monday the vehicle was impounded and waited on a warrant.

Probable cause should have been enough for the detectives on scene to search the vehicle for a gun when the shooter was saying that there was a gun.

he is facing hayes with his wife inbetween, he turns to his right to go back to his vehicle and gets shot in his left side. we know that the altercation had moved back closer to smiths car by that time due to casings

we would have to see the bullet trajectory to know for sure.

Watch this video again and cover up Smith's vehicle with your hand. There is no clear evidence that Smith hit Hayes. Hayes' vehicle does not change speed or jolt forward. It just appears that way due to Smith slamming on his brakes

Considering his wife is now testifying that after the second accident she thought they were being attacked. It sure sounds like that at least she new that Will hit Hayes.

Lots of times if I think someone may rear end me, I get off the brake and creep up a bit more to help...

But in fairness I'm not looking for insurance checks

I dont see how anyone can say beyond reasonable doubt that Hayes committed murder 2. And that is based on what the prosecutions witness is saying
