You are trying to only apply what is the direct letter of the law. You are forgetting what a jury will think when all of the evidence is presented.
Based on what you have posted today we would have exclude all evidence of what happened prior to Cardell Hayes pulling the trigger.

Based on this testimony I'm inclined to believe this trial might be over by Friday evening (monday at the latest) and that the Jury is not going to find him guilty in this matter. Its not clean and there are too many idiots at this party on both sides to make a clean determination.

Too early in the prosecutions case for me to say not guilty yet. I want to hear more of the story.

its the reason two families may have lost their fathers.
I hope people learn from these 2 shootings. just let the cops handle the hit and run/ and or road rage. its not worth it

I get them asking about him firing a gun, but wouldn't the crime scene been indicative of him firing a weapon before/during being shot?
