Hayes didn't set out that day to kill anyone. But IMO he had intent to kill Smith with no justification to do so. He's not cold blooded.
But see I was saying he wasn't a 'stone cold killer', using the definition I've gathered from tLSU's post describing the difference between manslaughter and Murder2...
You may recall but if not you could probably go back and look, since I saw him post it at least twice but maybe three or four times. But the way he explained the difference from it going from manslaughter to murder2 is the time that the fight had defused with Will calmed down walking away and CH having enough time for his "blood to cool" and then still shooting WS.
Do you follow what I'm saying and where I'm getting my definition of "stone cold killer" that I used earlier?

Sorry if if I was wrong with my definition and I was confusing people with the wrong term...
I honestly didn't know the difference. I just figured 'cooling' of the blood...
Apologize for my confusrion.
Eta: LNCH would you mind showing me in the Louisiana statute code where "stone cold killer" is someone that is murder1 and not someone murder2? Obviously it isn't manslaughter since I believe they mention some type of boiling of the blood or another.
