Well, yes. He's charged with murder -2 and I believe in Louisiana, the only way to get Murder 1 is to kill a cop, amirite OT Legal Egals?

i told you what I thought my definition of stone cold killer was and explained why as it aligned with murder2 the way the statute reads and with tLSU mentioning the 'cooling' of the blood.

Id love to see what is going on in the jury deliberations. Judging by these discussions it is really hard to make someone change their mind. potential to be a huge clusterfrick in there.

smith was shot near his car. There was a gun in his car.........

unfortunately, he was shot in his LEFT side first, then 8 more times. His wife testified she had calmed him down and 2 people testified they though the situation was diffused.

THEN HAYES testified SMITH SHOT AT HIM, which literally nobody else said or even thought, even Hayes best buddy.

Huge misstep by the defense. even without this misstep, I would vote guilty of Manslaughter or possibly Murder 2, but could see if others voted criminal injury to Raquel.....

With his statements, I vote guilty and cannot understand how you arrive at another conclusion.

I guess I missed this. A stone cold killer plans the murder in advance. Hayes didn't do that. What he did falls in line with part 1of the murder 2 statute.

Hayes didn't set out that day to kill anyone. But IMO he had intent to kill Smith with no justification to do so. He's not cold blooded.

Ok let me clear it up. I said my definition of someone that commits murder2 defines them as a stone cold killer.... I still think that and I've explained why I think that with the blood 'cooled' by the time the decision was made to kill.

Ok we get that right?

Well you tell me that I'm wrong?

I then ask if you would please share your definitions of a stone cold killer and how it wouldn't fit the description of someone convicted of murder2...


Please help me here. If I read something wrong with the discussion we have had then correct me and tell me bro, that's all. Don't just have to say "you're wrong?" "That isn't the question"..
