Of course he could have. But know you aren't being fair Racquel testified it is usually in glovebox At crime scene, glovebox is open and the gun is not there, but in between seats instead

Immaterial where his gun usually is kept. Gun expert said it had not been fired and it was testified that it was in its case.

You really believe Will Smith fired a shot at Hayes, put the gun back in its case between the seats all in the time before he was shot 8 times and died? Maybe it was a magic gun that holstered itself.

But CH says gun was brandished and fired, which never happened from all objective evidence. Credibility gone and now just smoke and mirrors by Fuller IMO

If you want to make it that cut and dry, the states witnesses have said some thugs that have been proven wrong as well. So all credibility gone for them as well?

You take out CHs bs, no justification for killing someone with back turned for screaming at you or a potential fist fight

If the gun was in the glovebox normally, and at the scene of the crime the glovebox is open and the gun is not there, many will logically believe someone grabbed the gun out of the glovebox

Many will not view that as immaterial, as they will think Hayes possibly saw Smith grabbing it

What about if Smith was grabbing gun from glovebox, which is very logical considering glovebox was open and gun was in between seats

The only thug that has been proven wrong is Hayes. His testimony is all a dream or delusion. It didn't happen the way he said it did. No one corroborates ANY of his story.

Ok so I just talked to JR. He said the YouTube video was mentioned but it wasn't admissible because the person filming at the time was actually part of the media and he didn't know it at the time. Also he admits he said some stuff right after that he was confused about... take it for what it is.

So Hernandez isn't a thug that was proven wrong?

And I meant to say "things"

Didn't Hayes say that he didn't get behind Smith?

How the F could he see Smith grabbing a gun from anywhere else but behind him.

You're grabbing at straws while sniffing Hayes' undies.

Once again, nobody in here pro prosecution can have discourse when discussing the case without attaching with something "you are related to Hayes" or "sniffing Hayes undies"

It's hilarious

I am sorry tigress, it is a fact Smith normally kept his gun in the glovebox

It is a fact the glovebox is open

It is a fact the gun was not in the glovebox

Those facts will lead some to believe the gun was removed by Smith

You don't have to call me a Hayes undie sniffer for pointing that out

But that was my problem with Hayes testimony. If he would have left it there, I likely would have given him the benefit of the doubt. Instead he has to take it to a whole new level in that WS took gun from car, brandished it and the pop, a shot. Just not seeing the latter part of it based on physical evidence and why I have a hard time now believing his story, including other parts of it

There are absolutely holes and inconsistencies in Hayes story

But that in itself doesn't prove the states case

John has marginally improved. Still disorganized and as bad as I've ever seen him in a closing.

I have no doubt this would be the case IF Smith was a white man. Racism continues to exist if they let off a murderer for murdering Willl Smith and attempted murder of Mrs. Smith when they have their chance to deliver their verdict.
