Hayes, again, reiterates to Napoli that he is simply sharing what he saw, heard, felt from his perspective.

Italian guy said he was focused on Hernandez and didn't see the shooting happen. It all could have happened in seconds. Which it sounds like it did

ADA Napoli asserts Hayes is the only person to say Richard Hernandez said Hayes had a gun but was scared to use it.

Which puts it as no one willing to provide eyewitness accounts to corroborate Hayes' version. There is absolutely no evidence to support his claims. Logically that means his version is least reasonable.

True, and he was not there during the "altercation"

Hayes passenger was there though, and not drunk.

He never testified to Smith firing a shot. He was at the cars. He would have known.

Hayes just fricked himself by saying Smith threw O'Neal down but that O'Neal didn't testify to that because he is "prideful."

So why didn't he shoot that guy?

So now Hayes is claiming O'Neal omitted being thrown to the ground because he's "prideful"

He is now saying he saw Smith with a gun in his hand.

quote:

JN: "Did you ever see a gun in Will Smith's hand?"
CH: Yes.
JN: "You never say that -- ever" in prior statements.

Hayes with the boom

Hayes already had about 10 booms in this case...8 of them killed Will Smith and the other two injured both of Will Smith's wife's legs.

Which calls in to question his testimony.

I don't believe for a second that a man (carrying a gun) can hear 2 shots that have been fired within 20' of him and not determine who fired those shots. Did he draw his gun at that moment? Go to see is Hayes needed assistance?

It doesn't add up. What does add up is feigned ignorance to cover for his friend. He was coached by the defense attorneys.... "Do you KNOW who shot those first 2 shots? DID you SEE them discharge?"... "No I did not"... "Good, and that should be your testimony"... "Do not change it, for any reason".

Just let it's obvious the Smith Camp won't admit to be aggressors. Which everyone has stated this.

Lots of lying going around
