Napoli: Answer my question. You left out the detail that Will Smith had a gun in prior statements? Hayes: I can't recall what I said.

Hayes adds he didn't tell everything to the police in an apparently excluded statement.

Hayes reiterates, 'I never made a full statement to anybody except my lawyers.'

Cacciopo testified earlier in the trial that he saw Hayes advance on Smith and open fire with his left hand.

Napoli referred to Cacioppo's statement. Hayes said: I am not left-handed. I am right-handed.

Except for the expert who said Cardell Hayes rammed his vehicle into the Mercedes, which is considered "aggressive" to some.

That's why I laugh when you cast to me to one side.
My stance is there were lots of trashy people there.
Lots of people involved seem to be lying about at least something
Nobody saw 10 shots fired? That alone just sounds crazy
But everyone at least agrees this guy is anot a-hole

I agree. Anyone that is dumb enough to believe that both parties were not extremely aggressive should never be allowed to be on a jury. A man intentionally smashed into a car at 20 mph. If you saw someone in your rear view follow you and then crash into you would you not be pissed? Obviously has was furious based off his decision to crash into Smith. Neither party was going to get out of their vehicles and not be furious.

The prosecution just needs to harp on this part. This destroys Hayes' credibility and if you feel he is lying here, nothing else he says really matters. His attorney would have been shouting this from the mountain tops from the beginning if this was actually the case. Everything revolves around there being a clear threat to Hayes' life and he has never mentioned it until now? Come on...

Napoli is asking Hayes about this because Hayes testifies 'I never got up on Will.'

quote:

Hayes: I'm not firing into the Mercedes. Napoli: But that's where Will is, right?
quote:

Hayes: It all happened so fast. Napoli: It's funny you say. Because witnesses say there was a pause between the (2 sets of) shots.
quote:

Hayes: I never got right behind, Will. Napoli: Once again, Cacioppo says he saw you shoot repeatedly into the open door of the Mercedes.
quote:

Napoli: Why would Cacioppo lie? Hayes repeats he can't speak for anyone else.

Lots of lying going around

Agreed. I just do not think it reasonable for one of 2 large armed fellows to shoot one of 3 unarmed fellows multiple times until dead. Particularly when it looks like the armed fellows chased them down and intentionally rammed them because of a previous minor fender bender.

Add in all that and it appears to me that Hayes was the real aggressor in this incident even though Smith and crew acted like Chalmette trash when they got out to confront Hayes for the second "accident".

But that is my reading of the events.

Napoli: You shot Will 8 times.
Hayes: I don't believe I did.

Hayes needs to be careful. He is arguing that the case has lots of contradictions, but in some instances Hayes is contradicting things that are established facts. That will cause him to lose credibility with the Jury.
