Racquel was near the driver's door with Will. She was shot and then crawled to the sidewalk behind or between some parked cars.

I thought she was in the other seat and she was hit as Hayes was shooting at Will. Was she inside or outside the car?

This whole trial and the future McKnight trial teach us the following:

1) Don't engage in road rage
2) Don't leave your vehicle if you are involved in one.
3) Acting like a hot head can lead to your untimely demise.
4) Don't drink and drive (smith incident)

Hayes is guilty. Will Smith is responsible for some of this. He had too much to drink, was driving over the legal limit, bumped into the hummer, fled that scene (probably to avoid the cops coming and performing a field sobriety test), Hayes then chases Will down, bumps him in retaliation, Smith now angry that he has been hit is angry and due to his inebriated state decides to keep it real and confront Hayes.
Hayes, also a larger man with high testerone, is not going to back down to someone,who wants to engage on disrespecting him and his hummer obliges Will Smith in the altercation. Hayes grabs his gun, smith sees said gun and in further effort to keep it real says something to the fact: you got yours let me get mine. Hayes after hearing this and seeing Smith retreat to seemingly get his gun opens fire.

Murder 2 maybe
Manslaughter more likely.

Will Smith at 34 with two kids, beautiful wife, and millions in the bank is still alive today had he not fled the scene of the first contact with Hayes had he just calmly stopped, exchanged information, and gone on his way. Perhaps Hayes would not have wanted to call the cops once he saw who had hit him

Alcohol, not consumed repsponsibliy, can lead to poor choices setting off a chain of events that can lead to death.

She was shot when standing by Will by drivers side door is my thinking.

zero blood to be found from a woman that would have been crawling out and around.

well, if prosecutions opening remarks are supported by evidence, he should get the chair.

You don't gun down someone in cold blood and get away with it.

Just like that cop should get convicted of shooting that unarmed man.

I agree with all of this.

I've been in 2 fender benders where we didn't call the cops. Exchanged info and went on our way. I gave 1 fella $100 and fixed his bumper.

I don't understand why the gun wasn't seized then. Was other evidence like the casings found in the Mercedes or the projectile fund in the passenger door seized that night or after the search warrant was obtained?

I remember them stating they was no gun from that night all the way until Monday the next week.

Yeah it was pretty fishy considering Smith had just left dinner with a former NOPD officer.

That's a fairly hypocritical strategy there Johnny. Prosecutors have stated Cervolo is on surveillance away from the scene but its not ignorant to still roll with the whole sounds fishy theories.
