I may be wrong, but I believe you can technically "drink and drive" in North Dakota as long as you are under the legal limit.

I've always heard passengers can drink in the car in Nashville, but I've never gotten confirmation of that.

There already are different consequences for each of those situations.

I know but they aren't harsh enough. over .16 makes it harder to get your license back from suspension etc.

I'm saying make that shite for REAL if you drive that drunk.
Nobody wants to touch that b/c it's kind of like accepting buzz driving isn't so bad.
But buzzed drivers don't make ghost bikes on Perkins.

Punish the shite-canned drivers much more harshly than buzzed drivers. Couldn't hurt and I believe it would work.

Passengers enjoying alcohol shouldn't be illegal.

Anyone want to bet by the time autonomous cars become common, that the law will be written so that even though no one is driving, no one can be drinking? The popo have way too much $$$ to lose by letting it slide.

It may have changed, but last I checked LA still made it legal to drink in the car so long as the person driving is for hire.

How do you punish the drivers that are passed out at stop signs or red lights but only blow a .01 or .03 bc they've taken pills with the alcohol and can barely stand?

Because people, particularly in LA (especially in South LA), think it's impossible to have a good time without alcohol being involved

Drinking at social gatherings is common throughout the world. It's really only in areas with very conservative religious beliefs that it isn't really practiced.

Now, the volume in which alcohol is consumed varies drastically. South Louisiana in particular is notorious for consuming more than a drink or two.

Ascension Parish has quite a few.

Concordia Parish(Vidalia) has a bad arse drive through store where you can get Daqs for mom and dad, icees for kids, candy, 12 pack of beer, etc all without getting out.
Hammer's.

Also has a drive through bar where you can order mixed drinks at the window. That's pretty damned cool to be like "yea triple gin and tonic"(in a large daq cup).
McDonough's

By doing this you eliminate all the 'back-door handshakes' and bribes that judges, DA, ADA and whoever else receive when the guy that rolls in with a .20 or greater BAC pays 20K to get out of it.

i got part of it wrong. The PASSENGER is charged with a DUI if the driver is drinking
quote:

Also, you can be charged with DUI if you are a sober passenger in the car. In Story v. United States the court ruled that “when one sits by the side of another and permits him without protest to operate a vehicle on a highway in the state of intoxication, the one sitting by is as guilty as the man at the wheel.” So if you ever think that someone driving might be intoxicated, it could be worth $5,000 and at least a day of your life for you to find a sober ride home.

quote:

If the driver commits a crime, the owner or passenger is guilty of aiding and abetting the crime. Tennessee courts have recently charged a passenger with manslaughter as a result of the driver’s actions and stated that the law extends to owners as well.
