"you can sheer a sheep many times but only skin him once."
If you went all out and cracked down with a vengeance then you would have a few months of record $$$ coming in but you would have kill the goose that lays the golden egg to do it.
DUI law has never been about safety. Its about revenue. If there was no money for the government in it MADD would have been told to frick off long ago.

If you injure or kill someone, it should be able to rise to a manslaughter/murder charge.
I am guessing you want to lower the tolerance too right?
The only people that would win under your proposal is the prosecutor, defense attorneys, and the arresting officer.

True, I don't think drive thrus are legal in EBR, but pretty much all the surrounding areas and parishes have them

Drinking at social gatherings is common throughout the world.
Not saying it's uncommon. But from reading a lot of threads here involving alcohol, most people would boycott the second coming of Jesus if there wasn't any alcohol present. Of course, I should know better than to take the OT as a representation of real life.

It's simply part of the culture. At wedding receptions, a cash bar is the minimum that is expected. If they can afford it, most people choose to have an open bar of some level out of courtesy to their guests.

If he didn't turn water into wine when he showed up then how else would we know it's him?

I didn't say that. I just don't want people who are drinking on the roads. Get a cab/uber, etc.
Why on earth would I get a cab after a couple beers, especially when I'm not far? I'm not going to leave my car somewhere when I'm not even buzzed.
You fricking teetotalers are cuckoo.

Tennessee's open container law has puzzled people for years. You can't drink alcohol and drive, but your passengers can.

Bill to ban passengers from drinking in vehicles fails
The latest effort to make it a crime to have open alcohol containers in vehicles driving on Tennessee roads has failed in a House committee.
It's already illegal in Tennessee to consume alcoholic beverages while driving, but that law does not extend to passengers.

The drinking laws up there are some
Of the most ridiculous in the country. If someone gets drunk at a restaurant and gets in a car accident, the server and the restaurant can be liable. We were always told that if someone was obviously drunk, we had to cut them off, offer to get them a cab, and if they refused, we were to advise them that we were calling the police.

Exactly. If it were about safety, you would see much more money being thrown at perfecting preventive measures such as autonomous vehicles, interlock devices, etc, instead of making the laws "tougher."

FWIW, I got pulled over DD'ing for the wife and her friends once and they had drinks and the cop knew I was sober and let me go.

MADD and similar groups would rather have a zero tolerance law.
Unfortunately 0.08 is just low enough, that some people could pop off on a breathalyzer after just a couple of drinks.
If I had a couple of beers with dinner, I find myself more paranoid about the cops than any sort of accident.

Why?
because i am almost positive a friend got arrested for a DUI because they were drinking as a passenger.

Reading the McNair thing, I think it was because he consented to someone drunk driving his car while he was in it.
He wouldn't be charged with anything in someone else's car.

Can you Imagine how boring that would be?
Lucky for me Jesus is more of a South Louisiana Catholic and loves Mardi Gras and beer and dancing and crawfish and wine.
Baptist Jesus just seems to hate fun.

Was it his car that he consented to a drunk person driving?
