Whenever we’ve had test at my work (random or when I’ve had to order one) if they ever come back positive for alcohol, they immediately run the machine again using a test sample to show that it works, then take a second test within fifteen minutes.

If you read the thread, apparently the company’s position was that the nurse blew a .000 30 min after he left so that “proved” it was correctly calibrated.

If the clinic has their shite together on testing methods and validation of identity, a lawyer would have a field day with it.

For reference, when I was 19 or so someone had a breathalyzer in Tigerland and I felt extremely Tigerland drunk (had to lean on the bar for balance and couldn’t walk straight, was slurring and couldn’t see well or focus my eyes, was having memory brownout, etc.) and I blew a 0.17. Maybe things change for older people who’ve been alcoholic for a long time, but most normal people are going to be a complete shitshow at 0.25 and probably throwing up and falling on the ground

You build up tolerance with abuse and age. My ex wife is a perfect example. She was a master at having vodka hidden and masking the fact that she was completely shite faced (usually with the help of adderall). She once went in to a doctor’s appointment and the doctor picked up something was off so they pulled blood on her. She was borderline alcohol poison. They nearly sent her to the ER to have her stomach pumped. This 110 lb woman was still walking around and acting halfway normal while being borderline alcohol poisoned and this was a regular thing for her. Last I heard she was in the ER earlier this year with kidney failure.

Eh Depends, many alcoholics live and function in the .250 range and start to go through DTs around 200 or less.

Every Intoxilyzer has a pretest that is supposed to spit out a report showing that it ran flat zero, plus or minus .001. If that procedure is followed, residual sample issues should never happen.

Thats crazy!

Did anyone else blow above 0?

Were you first to test or in the middle/end of line?

Did you also get a blood draw at clinic?

What we have here is no common sense. If staff knows you then someone else would have protested that its not correct. Yet everyone doing the testing will just say they are doing their job. They should have tested someone after you and then you again to make sure the machine is correct due to such a high number for someone who is acting sober.

You will win a lawsuit but that still doesn’t get your job back plus the lawyer will take half of winnings. And when you need a ref they won’t give you one due to nature of it.

Maybe with luck a lawyer will get your job back and an apology but thats a long shot
