In Texas it's qualified by the demonstration of mental impairment. Showing the police a still burning joint as evidence against himself pretty much proves he wasn't thinking too clearly. Maybe a FAS baby like yourself doesn't see the problem but those of us who prefer people to drive sober certainly do.

So it could be determined that his driving ability was impaired (because that's the real statute in Texas, not yours) by him sitting in the drive through?

Surely they have some evidence of his driving ability to be impaired as he was exiting the drive through onto the road?
